State of Delaware Talent Agency Law

The State of Delaware enforces a Talent Agency Law to protect performers from unscrupulous and exploitative practices by talent agencies. This law requires all talent agencies operating in the state to be licensed and bonded, and establishes certain regulations governing their business practices.

The law defines a "talent agency" as any person or company engaged in the business of procuring, offering, promising, or attempting to procure employment or engagements for an artist or performer. This includes booking agencies, management companies, promoters, and production companies that engage in talent scouting and booking.

All talent agencies operating in Delaware must be licensed by the state's Department of Labor. A license application must be filed with the Department, and the applicant must submit proof of financial responsibility in the form of a surety bond. The bond must be in the amount of $50,000, and must be issued by a company licensed to do business in Delaware.

The law requires talent agencies to maintain certain records, including contracts with artists and performers, invoices for services rendered, and a register of all persons employed by the agency. These records must be made available for inspection by the Department of Labor at any time.

Talent agencies are prohibited from charging artists or performers any fees for their services. They are also prohibited from making false or misleading statements about their services, or about the employment opportunities they may have available.

Violation of the Talent Agency Law is a misdemeanor, punishable by a fine of up to $5,000 and/or imprisonment for up to one year.

The State of Delaware's Talent Agency Law is designed to protect artists and performers from being taken advantage of by unscrupulous agencies. If you are considering signing with a talent agency, be sure to research the company thoroughly and make sure they are licensed and bonded in Delaware. You should also review your contract carefully before signing to make sure you understand all of the terms and conditions.
